Intellectual Property - Copyright

Intellectual Property (IP) refers to creations of the mind: inventions, literary and artistic works, and symbols, names, images,
and designs used in commerce. IP is divided into two categories:  Industrial property, which includes inventions (patents), trademarks,
industrial designs, and geographic indications of source; and Copyright, which includes literary and artistic works such as novels,
poems and plays, films, musical works, artistic works such as drawings, paintings, photographs and sculptures, and architectural designs.  
Rights related to copyright include those of performing artists in their performances, producers of phonograms in their recordings,
and those of broadcasters in their radio and television programs. “

Copyright - Copyright is the exclusive right given to the owner of a copyright for a specific period. Copyright protection in Malaysia is
governed by the Copyright Act 1987. There is no system of registration for copyright in Malaysia. A work that is eligible is protected
automatically upon fulfillment of the following conditions:- 
 
  • sufficient effort has been expected to make the work original in character;
  • the work has been written down, recorded or reduced to a material form; 
  • the author is qualified person or the work is made in Malaysia or the work is first published in Malaysia

Guideline CR-1 Form (MARCH 2022)

Assalamualaikum & Salam Sejahtera,
 
 
These Forms are to be filled in by USM lecturers/staff AND must be a citizen/ permanent resident of Malaysia*.
(*However, based on our previous experience, whereby USM is the copyright owner, MyIPO accepted filing from non-citizen)
Guidelines to fill in the Forms are as follows:
  1. CR-1 Form (for original work & derivative work )
    Please fill in Section A, B, C, E (if applicable) & G
    - Section A : Category of Works,   Please tick only ONE category of work in item (i) or (ii)  * For derivative work (e.g: translation/compilation)
    - Section C : Authors -  If more than one author, please leave this section blank 
    and use the attachment provided.
    - Section D : Owner - Do not amend this section. However, if there is JOINT-OWNERSHIP involved, please contact us.
    - Section F : Contact Person -  Do not amend this section.
    - Section G : Declaration - please tick 'author of the work' & sign.
    - Section H : Mode of Delivery for Certificate -  tick 'by post'

  2. Copyright Work  2 copies
    a. Only electronic/softcopy accepted. 
       You may submit your work in the form of CD, DVD or Thumb Drive.
    b. Size of work for each application available to 3GB.
    c. Size of work more than 3GB will be charged with extra payment.

  3. Prescribed Fee
a) Fee for deposit of work submitted manually or online is RM200 on a ‘one-off’ basis. The RM200 fee covers works up to 3GB. The next additional 1GB will be charged at RM20
b) Manual application is available with payment of administrative fee of RM50. This is currently waived until MyIPO's online system is ready.

For manual application through our office, kindly prepare payment in the form of Malaysian Postal Order (Wang Pos Malaysia) / Money Order (Kiriman Wang) / cheque / bank draft. For payment using PO, please note that there will be delay in the application as MyIPO will only issue filing details when they have received the payment.
  • Malaysian Postal Order (Wang Pos Malaysia)
    -please leave blank at  the recipient's name on the Postal Order
    [*As we just notice that the Post Office has increased the fee for  Malaysian Postal Order (Wang Pos Malaysia), you might want to consider using Money Order (Kiriman Wang) OR other forms of payment instead]   

  • Money Order (Kiriman Wang) / cheque / bank draft.

  • Before leaving the post office please make sure each sheet of postal money / money order has the stamp of the date of purchase and please make sure the recipient's name is correct and there are no spelling mistakes.

FOR USM lecturers/staff who wish to submit the copyright to MyIPO by themselves:
  1. Please fill up the relevant forms & email to us for review.
  2. Then, you may submit your copyright manually to the nearest MyIPO branch counter OR online through the MyIPO website. 
  3. Upon completion of the application process,  please email to us a complete set of documents for record purposes. If the document is incomplete/incorrect your copyright will not be recorded. Documents that need to be sent via email are:
    • CR-1 form 
    • Attachment for CR form (Section C: Author) - if applicable 
    • Copyright Work - if the work cannot be uploaded due to the large file size factor, you can upload the work into one drive or google drive and share the link with us (youtube link not accepted). Please ensure that the file can be downloaded for storage as we might need it for record & audit purposes.
    • Official receipts and filing slips from MyIPO
  • Certificate and notification slips (if the copyright system has been opened for online application)
*Currently, MyIPO online applications are temporarily closed and no administration fees are charged for manual application.
